【概要描(miao)述】十八屆四中全會決定指出:“實現經濟發展,必須更好發揮法治的引領和規范作用”。法律服務隊伍作為處理法律事務和防范法律風險的專業力量,在服務和保障重點項目建設方面具有獨特的作用。
重點項目建設需要法律服務和保障。一是促進政府重大投資項目立項決策科學化的客觀需要。法律專業人員可以協助政府從法律上對項目是否符合國家產業政策、是否符合相應的規劃要求,進行可行性分析,提出專業法律意見,防止立項風險評估不到位而出現重大投資損失。二是服務保障重點項目建設健康運行發展的重要內容。律師、公證、司法鑒定等法律服務機構可以為重點項目的招商引資、兼并整合、契約維護、生產經營、招投標活動等提供專業服務,幫助避免或減少法律風險。三是提升政府應對社會穩定風險能力和水平的有效舉措。聘請專業法律顧問,提前預測項目對民生及社會穩定的影響,可以使政府更加合理地決策,針對問題及早制定預案。
法律服務重點項目機制亟待進一步完善。一是法律服務重點項目建設的廣度和深度不斷拓展,但法律服務的法定地位和效力從制度上還不夠明確。二是政府部門發揮法律服務人員職能作用的意識愈來愈強,但法律服務購買機制尚待進一步完善。三是項目建設對法律服務的需求愈來愈多,但法律服務自身的業務轉型升級還不能較好滿足經濟發展戰略需要。
努力提升法律服務重點項目的能力和水平。一應明確重點項目建設中法律服務的法定地位。從制度上進一步明確在政府重大投資項目的立項審批環節和招投標環節,應由法律專業人員進行合法性審查,并提供相應法律意見。二應建立重點項目建設購買法律服務招投標機制。積極推動相關政府部門以招投標形式面向整個法律服務行業購買法律服務,促進政府對法律服務資源的合理利用。三應加強對法律服務人員服務重點項目建設的指導。建立省政府相關部門溝通合作機制,積極為法律服務重點項目建設搭建平臺。進一步完善組團式、集成式、一站式的服務機制,積極在承接京津功能疏解、產業轉移、要素輻射方面發揮好作用。建立《京津冀司法行政工作協同發展框架協議》,建立健全法律服務人員跨區域流動機制,為法律服務重點項目建設提供有力的人力資源支撐。

法律(lv)服(fu)(fu)務(wu)重點(dian)項(xiang)目(mu)機(ji)制亟待進一(yi)步完(wan)善(shan)。一(yi)是(shi)法律(lv)服(fu)(fu)務(wu)重點(dian)項(xiang)目(mu)建(jian)設(she)的(de)(de)(de)(de)廣(guang)度(du)和(he)深度(du)不斷(duan)拓(tuo)展,但(dan)(dan)法律(lv)服(fu)(fu)務(wu)的(de)(de)(de)(de)法定地位和(he)效力(li)從制度(du)上還不夠明確。二(er)是(shi)政府部門發揮法律(lv)服(fu)(fu)務(wu)人員職能作用的(de)(de)(de)(de)意識愈(yu)(yu)來(lai)愈(yu)(yu)強,但(dan)(dan)法律(lv)服(fu)(fu)務(wu)購買機(ji)制尚待進一(yi)步完(wan)善(shan)。三是(shi)項(xiang)目(mu)建(jian)設(she)對法律(lv)服(fu)(fu)務(wu)的(de)(de)(de)(de)需(xu)求愈(yu)(yu)來(lai)愈(yu)(yu)多,但(dan)(dan)法律(lv)服(fu)(fu)務(wu)自身的(de)(de)(de)(de)業務(wu)轉(zhuan)型升級還不能較好滿足經濟發展戰(zhan)略需(xu)要(yao)。
努力提(ti)升法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)重(zhong)點項(xiang)(xiang)(xiang)(xiang)目(mu)(mu)的(de)能(neng)力和水平。一(yi)應(ying)(ying)(ying)明(ming)確重(zhong)點項(xiang)(xiang)(xiang)(xiang)目(mu)(mu)建(jian)(jian)設(she)中法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)的(de)法(fa)(fa)定地(di)位。從制(zhi)度上進一(yi)步明(ming)確在政(zheng)(zheng)府重(zhong)大(da)投資(zi)項(xiang)(xiang)(xiang)(xiang)目(mu)(mu)的(de)立項(xiang)(xiang)(xiang)(xiang)審批環節(jie)和招投標環節(jie),應(ying)(ying)(ying)由法(fa)(fa)律(lv)(lv)(lv)(lv)專業(ye)人(ren)(ren)員進行合(he)(he)法(fa)(fa)性審查,并提(ti)供相(xiang)應(ying)(ying)(ying)法(fa)(fa)律(lv)(lv)(lv)(lv)意見。二應(ying)(ying)(ying)建(jian)(jian)立重(zhong)點項(xiang)(xiang)(xiang)(xiang)目(mu)(mu)建(jian)(jian)設(she)購買(mai)法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)招投標機(ji)制(zhi)。積極(ji)推動相(xiang)關政(zheng)(zheng)府部門(men)以招投標形式面向整(zheng)個(ge)法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)行業(ye)購買(mai)法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu),促(cu)進政(zheng)(zheng)府對法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)資(zi)源(yuan)的(de)合(he)(he)理利用。三(san)應(ying)(ying)(ying)加強對法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)人(ren)(ren)員服(fu)務(wu)(wu)重(zhong)點項(xiang)(xiang)(xiang)(xiang)目(mu)(mu)建(jian)(jian)設(she)的(de)指導。建(jian)(jian)立省政(zheng)(zheng)府相(xiang)關部門(men)溝通合(he)(he)作(zuo)(zuo)機(ji)制(zhi),積極(ji)為法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)重(zhong)點項(xiang)(xiang)(xiang)(xiang)目(mu)(mu)建(jian)(jian)設(she)搭(da)建(jian)(jian)平臺。進一(yi)步完善組團式、集(ji)成式、一(yi)站(zhan)式的(de)服(fu)務(wu)(wu)機(ji)制(zhi),積極(ji)在承(cheng)接京津功能(neng)疏(shu)解、產業(ye)轉移(yi)、要素輻射(she)方面發(fa)揮好作(zuo)(zuo)用。建(jian)(jian)立《京津冀(ji)司法(fa)(fa)行政(zheng)(zheng)工作(zuo)(zuo)協同發(fa)展框架協議(yi)》,建(jian)(jian)立健全法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)人(ren)(ren)員跨區(qu)域(yu)流動機(ji)制(zhi),為法(fa)(fa)律(lv)(lv)(lv)(lv)服(fu)務(wu)(wu)重(zhong)點項(xiang)(xiang)(xiang)(xiang)目(mu)(mu)建(jian)(jian)設(she)提(ti)供有力的(de)人(ren)(ren)力資(zi)源(yuan)支(zhi)撐。
